Terms and Conditions

1.PARTIES

This contract is made between the parties specified below, under the terms and conditions written herein.

By accepting this contract, the BUYER acknowledges that upon confirming the order, they will be obligated to pay the order amount and any additional fees such as shipping costs and taxes and that they have been informed about this obligation.

DEFINITIONS

In the application and interpretation of this contract, the terms defined below will express their corresponding written explanations:

LAW: Law No. 6502 on the Protection of Consumers,
REGULATION: Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188),
SERVICE: Any activity provided for a fee or consideration other than the provision of goods,
SELLER: The company that offers goods to the consumer as part of its commercial or professional activities or acts on behalf of or for the account of the seller,
BUYER: A person or legal entity acquiring, using, or benefiting from a good or service for non-commercial or non-professional purposes,
SITE: The internet site belonging to the SELLER,
ORDERER: A person requesting a good or service via the SELLER’s internet site,
PARTIES: The SELLER and BUYER,
CONTRACT: This contract made between the SELLER and the BUYER,
GOODS: Tangible goods subject to the sale and intangible assets prepared for use in electronic environments, such as software, sound, images, etc.

SUBJECT

This contract regulates the rights and obligations of the parties concerning the sale and delivery of the product, which the BUYER has ordered electronically from the SELLER’s internet site, according to the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

The prices listed and advertised on the site are sales prices. The advertised prices and offers are valid until updated or changed. The prices advertised for a limited time are valid until the end of the specified period.

PRODUCT/PRODUCTS/HANDLING INFORMATION SUBJECT TO THE CONTRACT

7.1. The essential characteristics (type, quantity, brand/model, color, number) of the goods/products/services are published on the SELLER’s internet site. If the seller has organized a campaign, you can review the essential characteristics of the relevant product during the campaign period. This is valid until the campaign date.

7.2. The prices listed and advertised on the site are sales prices. The advertised prices and offers are valid until updated or changed. The prices advertised for a limited time are valid until the end of the specified period.

7.3. The total sales price of the product or service, including all taxes, is shown below.

7.4. The shipping cost will be borne by the BUYER. The shipping cost will be determined and communicated to the BUYER at the time of delivery of the order.

Invoice Delivery: The invoice will be delivered together with the order to the invoice address during the order delivery.

GENERAL PROVISIONS

9.1. The BUYER acknowledges, declares, and commits that they have read and understood the essential characteristics of the product subject to the contract, the sales price, and preliminary information regarding payment and delivery. The BUYER accepts that they have obtained all necessary information regarding the address to be provided by the SELLER, the basic characteristics of the ordered products, the price including taxes, and payment and delivery details accurately and completely.

9.2. Each product subject to the contract shall be delivered to the BUYER or the person/entity designated by the BUYER at the address indicated in the preliminary information section of the internet site, within a period not exceeding 30 days, depending on the distance of the BUYER’s residence. In the event that the product cannot be delivered to the BUYER within this period, the BUYER has the right to cancel the contract.

9.3. The SELLER undertakes to deliver the product free of defects, in accordance with the characteristics specified in the order, and with any guarantee documents and user manuals necessary for the performance of the work in accordance with legal requirements, in a manner consistent with standards, and to perform obligations in accordance with the principles of honesty and good faith.

9.4. The SELLER has the right to verify whether the product delivered to the BUYER complies with the characteristics specified in the order.

9.5. In case of any reason for the non-delivery of the product or service subject to the contract, the SELLER is obliged to inform the BUYER as soon as possible.

PAYMENT METHOD

The SELLER will collect the cost of the product requested by the BUYER and any shipping costs through the payment method indicated by the BUYER. Payments are securely processed online.

CANCELLATION AND RETURN RIGHTS

11.1. The BUYER has the right to return the product within 14 (fourteen) days without providing any reason from the date the product is delivered to them or to the person at the address they specified.

11.2. The BUYER must return the product in its original packaging, unused, and undamaged within 14 days after notifying the SELLER of the return request. The return period starts from the date the BUYER notifies the SELLER of the return request.

11.3. The shipping costs during the return of the product will be borne by the BUYER. The SELLER will refund the product price to the BUYER within 14 days after the returned product reaches the SELLER’s address.

OBLIGATIONS OF THE PARTIES

12.1. The SELLER is obliged to deliver the products to the BUYER within the specified period.
12.2. The BUYER declares that the information provided during the order process is accurate and up-to-date and acknowledges that the SELLER is not responsible for any inaccuracies.

CONFIDENTIALITY

The parties agree to keep confidential any information obtained during the transactions under this contract and not to share it with third parties.

GOVERNING LAW AND JURISDICTION

15.1. Turkish law shall apply to this contract.
15.2. For any disputes arising between the parties, the Istanbul Courts and Enforcement Offices shall have jurisdiction.

EFFECTIVENESS

This contract comes into effect when the BUYER places an order on the SELLER’s internet site.

COMPETENT COURT

In disputes arising from this contract, the Istanbul Courts and Enforcement Offices shall be competent.
